Holo Alert Terms of Use
1. Acceptance of Terms
Welcome to Holo Alert, a service provided by Holo Technologies Inc. (“Holo Alert,” “we,” “us,” or “our”). These Terms of Use govern your access and use of our website, devices, and services (collectively, the “Services”).
By accessing or using our website (www.holoalert.ca) or any Holo Alert product or service, you agree to be legally bound by these Terms of Use, as well as our Privacy Policy. If you do not agree to these terms, please do not use our Services.
We reserve the right to modify these Terms of Use at any time. Changes become effective upon posting. Your continued use of the Services after any updates signifies your acceptance of the revised terms.
2. Description of Services
Holo Alert provides personal emergency response systems (PERS), including wearable devices, 24/7 monitoring services, and location-based assistance. Our Services are designed to enhance safety and peace of mind, but they do not replace medical, emergency, or professional care.
Holo Alert does not guarantee that our Services will detect all falls, medical events, or emergencies. You should always seek immediate medical attention when needed.
3. Eligibility & User Responsibilities
To use our Services, you must:
- Be at least 18 years old (or have a legal guardian’s consent)
- Provide accurate, complete, and up-to-date information when registering
- Use the Services only as intended and in compliance with applicable Canadian laws
You agree not to:
- Use our Services for fraudulent, illegal, or abusive purposes
- Modify, reverse-engineer, or interfere with the Holo Alert website, devices, or services
- Submit false emergency alerts or misuse the 24/7 monitoring service
4. Location Services & Network Coverage
Holo Alert uses WiFi and cellular triangulation to determine your location. However, location accuracy is not guaranteed and may be impacted by factors such as network availability, signal strength, and environmental conditions.
The Holo Alert Service is available nationwide in Canada, but coverage may vary depending on cellular network providers. We are not liable for service disruptions due to:
- Network outages
- Weak cellular signals in remote areas
- Interference from buildings or other obstructions
5. Emergency Response & Limitations
Our 24/7 monitoring team will respond when the SOS button is pressed or a fall is detected (if enabled). However, Holo Alert:
- Does not replace 911, EMS, or medical professionals
- Cannot guarantee an immediate response if network connectivity is disrupted
- Is not responsible for delays caused by incorrect or outdated emergency contact information
In case of an emergency, always seek help from medical professionals or call 911.
6. Device Use & Maintenance
To ensure reliable performance, you agree to:
- Charge your device regularly as per the user manual
- Wear your device properly to maximize fall detection accuracy
- Test your device periodically to confirm functionality
Holo Alert is not responsible for issues arising from:
- Failure to charge or wear the device correctly
- User misuse, tampering, or unauthorized modifications
- Damage due to water exposure beyond IP67 resistance levels
7. Warranty & Liability Disclaimer
Holo Alert provides a limited warranty on its devices, covering manufacturing defects under normal use. However, we do not cover:
- Accidental damage, loss, or theft
- Unauthorized repairs or modifications
- Battery degradation over time
Limitation of Liability
To the fullest extent permitted by Canadian law, Holo Alert shall not be liable for:
- Direct, indirect, or incidental damages arising from the use or inability to use our Services
- Medical emergencies or injuries that occur despite using our devices
- Service disruptions beyond our reasonable control
If you live in Quebec or another jurisdiction where certain liability exclusions do not apply, our liability shall be limited to the greatest extent permitted by law.
8. Subscription & Payments
Holo Alert’s monitoring service requires an active subscription. By subscribing, you agree to:
- Provide accurate billing information
- Pay the monthly subscription fee for continued service
- Allow automatic billing unless canceled in advance
We reserve the right to adjust pricing with prior notice. If a payment fails, we may suspend or terminate service until payment is received.
9. Returns & Refunds
